These Terms and Conditions (“Terms”) govern your use of the SPIN THE NIGHT mobile application and related services (the “Service”). Please read them carefully, as they establish the rules for interacting with our platform and outline our ownership, limitations of liability and user conduct expectations. By accessing or using the Service, you agree to be bound by these Terms.
“App” means the SPIN THE NIGHT mobile application.
“Consumer” or “User” means an individual who registers to browse, book or attend restaurants or events using the App.
“Restaurant Business” means a business entity that lists dining experiences on the App.
“Event Business” means a business or organiser that lists events on the App.
“Content” means text, photos, reviews, ratings, menu descriptions, event details or other material posted or transmitted through the App.
“We”, “us” or “our” refers to the company operating the App.
Upon creating an account or making a booking, you will be asked to accept these Terms via a clickwrap mechanism (ticking a box or tapping “I agree”). This method ensures you explicitly acknowledge and agree to our Terms. If you do not agree, you must not use the Service.
In addition to clickwrap, the App and associated websites may display links to these Terms in prominent locations (e.g., the sign‑up screen, payment screens and menus) so you can review them at any time. Continued use of the Service constitutes acceptance of any updated Terms.
Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By registering, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
Account Information: You agree to provide accurate, current and complete information during registration and to keep your information up to date. You are responsible for safeguarding your account credentials and for all activities under your account.
Account Verification: We may require additional information to verify your identity or business status. Restaurant and event businesses may need to provide business registration or licensing details.
SPIN THE NIGHT provides a platform that allows:
Consumers to discover, book and review restaurants and events.
Restaurant businesses to list their dining experiences, manage reservations and receive payments.
Event businesses to promote events, sell tickets and communicate with attendees.
We act solely as an intermediary connecting users and businesses. We do not own, operate or manage the listed restaurants or events.
You agree to use the Service responsibly and to comply with all applicable laws. Prohibited behaviour includes, but is not limited to:
Misuse of the Service: Attempting to access or use another user’s account without authorization, interfering with the security or integrity of the Service or using automated scripts to collect data.
Illegal or harmful activity: Posting or transmitting Content that is unlawful, abusive, defamatory, discriminatory, obscene or that encourages harm or fraud.
Disruption: Engaging in conduct that could disable, overburden or impair the functioning of the App.
We reserve the right to suspend or terminate your account for violations of these Terms, consistent with our right to restrict abusive behaviour and delete inappropriate content.
Businesses listing on the App must:
Provide accurate information: Ensure that all listing information (e.g., menus, event details, pricing, availability and location) is truthful and updated.
Comply with laws: Hold and maintain all licences, permits and approvals required to operate. You are solely responsible for compliance with health, safety and venue capacity regulations.
Honour reservations: Accept bookings made through the App and provide services as described.
Manage cancellations: Clearly communicate any cancellation or no‑show policies to consumers. You must handle any disputes according to your policies and applicable law.
Payment processing: Consumers authorise us and our payment processors to charge the payment method provided for reservations or tickets. Businesses authorise us to collect payments and remit amounts due after deducting any service fees.
Transaction terms: Additional transaction terms may apply depending on the nature of the booking (e.g., ticket price, taxes, service fees). These will be disclosed at checkout.
Cancellations and refunds: Each restaurant or event may set its own cancellation and refund policy. We encourage businesses to state these policies clearly. If you cancel within the permitted timeframe, you may receive a refund as specified by the business. Otherwise, charges may be non‑refundable.
Disputes: If a dispute arises between a consumer and a business, we may attempt to facilitate resolution, but we are not liable for the conduct of any user or business.
Ecommerce apps, such as ours, should include clear clauses covering how different types of transactions are handled, payment terms and policies on returns, refunds and exchanges.
Our Service allows users to post ratings, reviews, photos and other Content. By submitting Content, you grant us a non‑exclusive, worldwide, royalty‑free licence to use, display, reproduce, modify and distribute your Content in connection with the Service. You retain ownership of your Content. However, you are responsible for ensuring that your Content does not violate any laws, infringe third‑party rights or contain personal data about other people without their consent. We may remove or edit Content that violates these Terms.
We own the Service and all related intellectual property rights, including trademarks, logos, design and software. You may not copy, modify, distribute, sell or create derivative works based on the Service without our written consent. Businesses retain all rights to their respective trademarks and copyrighted materials; however, by listing on the App, they grant us the right to display such materials for the purpose of providing the Service.
The Service may contain links to third‑party websites or integrate third‑party services (e.g., maps, payment gateways or social networking features). We provide access to these services only as a convenience. We do not control and are not responsible for the content, policies or practices of third‑party services.
The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the Service, including:
That the Service will meet your requirements or be available without interruption or error.
That the information provided (including listings, menus, prices or schedules) is accurate, complete or reliable.
That any defects or errors will be corrected.
We expressly disclaim any implied warranties of merchantability, fitness for a particular purpose and non‑infringement.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Service. Our total liability to you for any claim under these Terms is limited to the amount you paid to us (if any) for the transaction giving rise to the claim. Establishing our ownership of the Service and limiting our liabilities is important to protect our interests.
You agree to indemnify, defend and hold us harmless from and against any claims, liabilities, damages, losses and expenses (including reasonable attorney fees) arising out of or related to your: (a) use of the Service; (b) violation of these Terms; (c) violation of any rights of another person or entity; or (d) User‑Generated Content.
We may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms or if necessary to protect our interests or those of other users. You may cancel your account at any time through the App. Upon termination, provisions that by their nature should survive (e.g., intellectual property rights, limitations of liability, indemnity) will remain in effect.
We may modify the Service or these Terms at any time. When we do, we will update the “Last updated” date at the top and provide notice via the App or other appropriate means. Your continued use of the Service after changes become effective signifies acceptance of the updated Terms. We encourage you to review the Terms periodically. If you do not agree to the revised Terms, you must stop using the Service.
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict‑of‑law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan. You agree to submit to personal jurisdiction in those courts.
